Sealegs International Limited (NZX: SLG) has successfully obtained an interim
High Court injunction to protect its unique intellectual property from being
copied by Orion Marine, Smuggler Marine and others. Sealegs took legal action
against those parties including Mr Yun Zhang, aka Allen Zhang, for copying
and infringement of the Sealegs unique amphibious system design.
Justice Peters of the High Court in Auckland has placed an immediate court
order on Orion Marine, Smuggler Marine, Yun Zhang, Darren Leybourne and the
others involved which prevents them from any further copying, offering for
sale or displaying of the products which infringe on Sealegs designs.
This decision was reached, inter alia, on the basis that the defendants have
a substantial case to answer. A full trial hearing date has been set for
later in 2017.
A Sealegs spokesman said that "Sealegs is pleased with successfully securing
this High Court injunction to restrain the defendants from trying to sell a
copy of the unique Sealegs amphibious design". He added "We now look forward
to a successful trial in which Sealegs will be vigorously pursuing Orion
Marine, Smuggler Marine, David Pringle, Allen Zhang, Darren Leybourne and the
others involved for all costs and damages to the very fullest extent of the
law."
